urble Terms of Service

1. General

Brick Towers AG, Baarerstrasse 12, 6300 Zug, Switzerland, registration number CHE-378.414.731, operates urble. These Terms (“Terms”) govern your access to and use of the urble mobile application, website, and related services (collectively, the “Service”). References to “we”, “us”, or “our” mean Brick Towers AG; “you” or “user” means any individual using the Service.

urble provides non-custodial digital-asset functionality. While the Service may enable delegated transaction execution via smart contract-based accounts, users retain ultimate control over their assets through cryptographic authorization mechanisms.

We do not issue electronic money or provide regulated fiat-payment or brokerage services ourselves. Any fiat-on- or off-ramp transactions are executed solely by independent Financial Services Providers.

By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least eighteen (18) years old or the age of legal majority in your jurisdiction, whichever is higher, and legally capable of entering binding contracts. Brick Towers AG may, in the future, introduce limited-access versions of urble for younger individuals, subject to parental consent and special safeguards. Until then, the Service is intended only for users meeting the above requirement.

3. Use of the Service

You are responsible for maintaining your own device, internet access, and security (e.g., appropriate backup of your seed phrase, antivirus, password protection). We may modify, suspend, or discontinue any feature at any time. We make no guarantee of uninterrupted availability.

4. Smart Accounts and Delegated Execution

The Service may provide access to smart contract-based blockchain accounts (“Smart Accounts”). These accounts may enable enhanced functionality such as automated transactions, transaction sponsorship, and interaction with decentralized blockchain protocols.

By using Smart Accounts, you authorize Brick Towers AG to submit blockchain transactions on your behalf, in accordance with your prior authorization and predefined rules, solely for the purpose of operating the Service, including but not limited to:

  • sponsoring transaction fees;
  • executing predefined savings contributions;
  • interacting with supported smart contracts and protocols.

Such authorization is limited to predefined rules and does not grant Brick Towers AG the ability to unilaterally transfer, withdraw, or otherwise control your assets outside these rules. These predefined rules are determined by the functionality of the Service and your in-app configuration and consent.

5. Automated Transactions and Savings Features

The Service may include automated features that allocate, transfer, or deposit digital assets based on predefined rules (e.g., automatic contributions of ZCHF to savings modules or recurring transfers).

By enabling or using such features, you explicitly consent to these automated transactions being executed without further manual confirmation.

Transactions executed via automation are irreversible once confirmed on the blockchain.

We may introduce additional automated features over time. Where required, your consent will be requested before activation. You acknowledge that automated transactions may occur without real-time user interaction once enabled. Where available, you may modify or disable automated features through the Service interface.

6. Transaction Sponsorship (Gas Fees)

Brick Towers AG may, at its discretion, sponsor blockchain transaction fees (“gas fees”) for certain transactions.

Such sponsorship is provided as a convenience feature, may be limited, modified, or discontinued at any time, and does not create any entitlement or ongoing obligation. You remain responsible for any transaction fees where sponsorship is unavailable. Sponsored transactions may be subject to limits, delays, or prioritization criteria determined by Brick Towers AG.

7. KYC / AML and Sanctions Screening

We and/or independent Financial Services Providers may require you to complete Know-Your-Customer (KYC) or Customer Due Diligence (CDD) checks and ongoing screening under applicable anti-money-laundering, counter-terrorist-financing, and sanctions laws.
You agree to provide accurate information and updates on request. We may refuse, suspend, or terminate access if verification is incomplete, unsatisfactory, or prohibited by law.

8. Fiat Services via Third Parties

Any purchase or sale of digital assets for fiat currency (e.g., CHF / EUR) is executed solely by independent Financial Services Providers under their own terms.
Funding, settlement times, exchange rates, and chargebacks are determined by that provider. Brick Towers AG is not a party to those transactions and bears no responsibility for delays, reversals, or failures beyond its control.

9. Fees and Rates

Applicable fees are disclosed in-app prior to confirmation. Blockchain network fees may be sponsored by Brick Towers AG, included in displayed fees, or charged separately, depending on the transaction.

10. Transactions and Irreversibility

Transactions may be:

  • initiated directly by you; or
  • executed via Smart Accounts automatically based on your prior authorization.

All blockchain transactions are irreversible once submitted. Brick Towers AG cannot reverse or recover digital assets.

11. Smart Contract and Protocol Risk

The Service relies on smart contracts deployed on blockchain networks. Such contracts may contain bugs, vulnerabilities, or economic risks.

The Service may interact with third-party protocols (including savings modules such as Frankencoin). Brick Towers AG does not control or operate such protocols and assumes no liability for their performance or security. Such risks, including risks arising from changes to protocol rules, governance decisions, or economic design, may result in partial or total loss of digital assets.

12. Unauthorized Transactions

Transactions are executed from your self-custodial wallet or Smart Account using cryptographic authorization mechanisms under your control, including transactions initiated directly by you or automatically in accordance with predefined rules and your prior authorization.
We cannot reverse, recover, or replace assets sent or received through your wallet. If you suspect fraud involving a Financial Services Provider, contact that provider and notify us immediately.

You are responsible for securing your device and credentials. Transactions executed via Smart Accounts in accordance with predefined rules are deemed authorized.

13. Unmatched or Mistaken Payments

If we or a Financial Services Provider receive fiat funds that cannot be matched to your account or instruction, we will attempt to return them to the original source.
If the sender cannot be identified, funds may be held for a reasonable period and then handled in accordance with applicable unclaimed-property laws.

14. Receipts and Statements

After each executed transaction, we or the relevant provider will make a summary receipt available in-app or by email.
We may also provide periodic statements summarizing your activity for your records.

15. Geographies and Export Controls

Access to urble may be restricted where prohibited by export-control or sanctions regulations. You warrant that you are not located in, resident of, or acting on behalf of a jurisdiction or person subject to comprehensive sanctions.

16. Limitation of Liability

To the maximum extent permitted by law, Brick Towers AG and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, loss of data, or loss of access to your wallet.
Our total aggregate liability for all claims shall not exceed CHF 100.
Nothing limits liability for intent or gross negligence.

17. Intellectual Property

All content, software, and trademarks appearing in the Service are owned or licensed by Brick Towers AG. You may not copy, modify, or distribute them except as explicitly permitted.

18. Complaints

Please contact urble@bricktowers.io for user support or legal@bricktowers.io for formal complaints.
If your issue concerns fiat services handled by a Financial Services Provider, you must also follow that provider’s complaints procedure.
We will cooperate in good faith to route and resolve complaints appropriately.
Where required by law, information about external dispute-resolution bodies (e.g., Swiss Financial Ombudsman) will be provided.

19. Force Majeure

We are not liable for failure or delay caused by events beyond reasonable control–including market volatility, cyber-attacks, outages, war, pandemics, or acts of government.

20. Data Protection and Privacy

Brick Towers AG is the data controller for personal data it processes. Processing is conducted in compliance with the Swiss FADP and EU GDPR.

21. Dispute Resolution and Arbitration

Amicable Resolution

Before initiating formal proceedings, both parties shall attempt to resolve disputes amicably by written notice to legal@bricktowers.io within 30 days.

Arbitration Agreement

If unresolved, any dispute arising out of or relating to these Terms or the Service shall be finally settled by arbitration under the Swiss Rules of International Arbitration of the Swiss Arbitration Centre:

  • Seat: Zug, Switzerland
  • Language: English
  • Arbitrators: One, unless otherwise agreed
  • Applicable Law: Substantive laws of Switzerland (excluding conflicts rules and CISG)
  • Confidentiality: Proceedings and awards are confidential except as required by law or for enforcement.

Individual Proceedings Only

Arbitration shall be on an individual basis–no class, collective, or representative actions permitted.

Interim Relief

Brick Towers AG may seek interim or injunctive relief in any competent court to protect intellectual property, system integrity, or data security.

Binding Effect

The arbitral award is final and binding and may be enforced in any court of competent jurisdiction.

22. Governing Law

These Terms and any non-contractual obligations arising from them are governed by Swiss law.
Courts in Zug, Switzerland have exclusive jurisdiction for enforcement and injunctive matters not subject to arbitration.

23. Language and Precedence

These Terms may be translated for convenience. The English version prevails in case of conflict.
